As of February 2026, the Camp Lejeune mass tort case is entering a critical phase, with the first bellwether trials now realistically expected to begin later this year.

The primary focus for the thousands of families involved remains the transition from administrative paperwork to actual courtroom proceedings and global settlement negotiations.

Latest Litigation Milestones (Early 2026)

  • Bellwether Trials Set for 2026: While initially projected for 2025, the first “Track 1” trials—testing claims for serious diseases like leukemia, bladder cancer, and kidney cancer—are now anticipated to start in 2026. These trials are essential for establishing the “value” of claims and will likely dictate the structure of future global settlements.
  • Scientific Discovery Concluded: Much of the heavy lifting regarding scientific evidence and water modeling is finished. Both sides are currently battling over which expert testimonies will be allowed in court and how the government should calculate deductions (offsets) from potential payouts.
  • Global Settlement Framework: Two court-appointed Settlement Masters are actively working on a three-step path toward a global resolution. This includes using a random sample of 2,500 claimants to create a “settlement matrix” that could eventually apply to the hundreds of thousands of pending claims.

Administrative Claims and “Elective Option”

The Filing Deadline Has Passed: The official deadline to file new claims under the Camp Lejeune Justice Act was August 10, 2024. The Navy is currently no longer accepting new claims.

  • Massive Backlog: The Navy has received over 500,000 administrative claims. However, only a small fraction (roughly 13,000) currently meet the strict criteria for the government’s “Elective Option”—an expedited payout pathway offering between $100,000 and $550,000.
  • Current Payouts: As of late 2025, approximately $14.4 million had been paid out through the Elective Option, though most claimants have chosen to wait for the potentially higher awards that could come after the bellwether trials.

  1. Check Portal Status: If you filed by the 2024 deadline, you can track your claim through the Navy’s CLJA Claims Management Portal.
  2. Gather Records: Settlement offers are often delayed by missing documentation. Ensure your legal team has all service, employment, and medical records ready.
